Right of withdrawal

In accordance with article 5 D.L. 185/1999, if the customer is a consumer (that is a natural person buying goods a product for purposes that do not fall within the sphere of his commercial or professional activity, not purchasing goods with a VAT number), has the right to withdraw from the purchase contract for any reason, without the necessity to communicate any explanations and without any penalties, except for what follows in point 16.

To exercise such right, the customer will have to send a communication to I Ricambi della Vespa, within 10 working days after the arrival of the products. This communication has to be sent through recorded delivery with acknowledgment of receipt addressed to:

or with a telegram or a fax sent within 10 days and followed by a confirmation by registered post with recorded delivery within the following 48 hours. Once the said withdrawal communication has arrived, I Ricambi della Vespa will promptly communicate to the customer the instructions about how to return the product, which will have to get to I Ricambi della Vespa within 10 days after the authorization.

The right of withdrawal undergoes the following conditions:

• Such right can be exercised for the whole product only; it is not possible for parts of it/them (ex. accessories and similiar);
• The product bought must be intact and in its original packaging, complete of all its parts (packaging and documents/accessories included);
• In compliance with law, shipping costs about the return of the product must be paid by the customer;

The shipping is under the customer's complete responsibility until the certification that the warehouse has received the product; in case of damage during its transport, I Ricambi della Vespa will notify it to the customer (withing 5 working days from the arrival of the product at the warehouse), to allow him/her to file a complaint to the courier and get the refund of the product (if the shipping was covered by insurance); in that event, the product will be made available to the customer for its return, cancelling the withdrawal request.

I Ricambi della Vespa is not responsible for damages, theft or loss of products returmed with shippings not covered by insurance. As soon as the products gets to the warehouse, it will be examined to assess possible damages or tampering not linked to its transport. If the packaging is damaged, I Ricambi della Vespa will retain a percentage (under 10% of the product value) as a contribution of the restoration expenses.

Besides these possible costs to resore damages to the original packaging, I Ricambi della Vespa will refund the customer for the full amount of money already paid, within 14 days after the return of the product, through a refund of the amount paid. In this case, the customer will promptly communicate his/her bank account details so that the refund will be credited (the IBAN code of tha bank account of the person in the invoice)

The right of withdrawal can't be exercised if the product is not intact (packaging and content) when I Ricambi della Vespa verifies:

• The lack of the external packaging and/or of the internal packaging;
• The lack of some parts of the product (accessories, manuals, components);
• If the product damage was not caused by the transport

If the right of withdrawal can't be exercised, I Ricambi della Vespa will return the sold item to the customer, charging him/her for the shipping cost.
